DMCA Policy for Zucchini Gratin

Zucchini Gratin respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Zucchini Gratin will respond expeditiously to notices of alleged infringement that are reported to Zucchini Gratin's Designated Copyright Agent, identified in the sample notice below.

Filing a DMCA Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through Zucchini Gratin's website or services by completing the following DMCA Notice of Alleged Infringement and delivering it to Zucchini Gratin's Designated Copyright Agent.

Upon receipt of a Notice as described below, Zucchini Gratin will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Zucchini Gratin website.

Please note that if you fail to comply with all of the requirements of this section, your DMCA notice may not be valid.

  1. Identification of the copyrighted work claimed to have been infringed: Describe the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identification of the material that is claimed to be infringing: Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Zucchini Gratin to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
  3. Contact information of the complaining party: Provide your mailing address, telephone number, and, if available, email address.
  4. Statement of good faith belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy and authority: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature: Provide your full legal name and your electronic or physical signature.

Filing a DMCA Counter-Notification

If you believe that material you posted on the Zucchini Gratin website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to Zucchini Gratin's Designated Copyright Agent:

  • Identification of the material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Statement of good faith belief of mistake or misidentification: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber's contact information: Provide your name, address, and telephone number.
  • Statement of consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Zucchini Gratin may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Subscriber's physical or electronic signature: Provide your full legal name and your electronic or physical signature.
